Terms of Service

You must be at least 18 and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend accounts that violate these Terms.

TurnkeyHQ provides AI-assisted real-estate workflow tooling (concierge chat, comparative market analyses, lead prospecting/qualification, follow-up drafting, campaigns, and related features). Features available to you depend on your plan. During beta, the Service is provided on an evolving basis and specific features may change.

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). If your plan includes a free trial with a card on file, your card will be charged automatically when the trial ends unless you cancel before then. Credit / usage balances (“TKC”) are consumed as you use metered features and are non-transferable.

Fees are exclusive of taxes; you are responsible for applicable sales/use/VAT taxes, which may be collected via Stripe Tax. Prices may change with notice; changes apply to subsequent billing periods.

You may cancel your subscription at any time from your account settings or billing portal; cancellation stops future renewals and access continues through the end of the current paid period. Except where required by law, fees already paid are non-refundable, other than: a 14 days satisfaction window for a first paid subscription, and pro-rated refunds we may issue at our discretion for extended Service outages. You agree not to, and not to permit others to:

• use the Service to violate any law or third-party right;
• send outreach that violates the TCPA, CAN-SPAM, the Fair Housing Act, or applicable Do-Not-Call / consent / quiet-hours rules;
• upload contact data you lack a lawful basis to process or contact;
• attempt to circumvent usage limits, security, or rate controls;
• reverse engineer, resell, or build a competing product from the Service.

You retain ownership of the data and content you submit (“Customer Content”), including contacts and communications. You grant us a limited license to host and process Customer Content to provide the Service. You are solely responsible for the legality of your outreach — including consent, opt-outs, identification, and timing — even where the Service provides compliance aids (quiet hours, your business’s do-not-contact list, opt-out and unsubscribe handling). Those aids assist but do not substitute for your own compliance. The Service does not check numbers against the National Do Not Call Registry or any state registry; see §7.

TurnkeyHQ text messages. Alchemical AI LLC sends TurnkeyHQ text messages to account holders who opt in on the Integrations page: a daily summary, alerts about your account, and replies to messages you send to our number. The first text after you opt in is a confirmation. Opting in is optional and is not a condition of purchase or of using the Service. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; you will receive one confirmation text. Reply START to resubscribe. For help, reply HELP or email support@alchemicalai.com. Messages to your contacts. Texts and calls to your own clients and contacts are not part of the TurnkeyHQ text-message program and are not sent from its number. Where the Service texts or calls a contact on your behalf, it uses a number assigned to your business, and you are responsible for obtaining and documenting that contact’s consent (see §5–§6). You may not text or call anyone who has asked your business to stop, whatever the source of the number.

Prospecting data. The Service can provide you with names, phone numbers, email addresses and property information compiled from public records and commercial data sources. That information is provided for marketing reference, as is. It is not screened against the National Do Not Call Registry, wireless blocks or spam traps, and any do-not-call indicator shown is the source’s, recorded when the record was compiled. You decide who to contact and you are responsible for the lawful basis for each contact — including scrubbing against the National DNC Registry and any applicable state registry, honouring prior opt-outs, and obtaining the consent the TCPA requires before an automated or pre-recorded call or text to a wireless number. This information is not a consumer report and may not be used for any purpose the Fair Credit Reporting Act regulates: Alchemical AI LLC is not a consumer reporting agency, and this information may not be used to decide eligibility for credit, insurance, employment, housing or tenant screening.

The Service uses AI to generate drafts, analyses, and recommendations (e.g. CMAs, messages). Output may be inaccurate or incomplete and is not legal, financial, or professional advice. You are responsible for reviewing and approving any client-facing output before it is sent or relied upon. Valuations and market analyses are estimates, not appraisals.

Fair Housing review remains yours. The Service instructs its AI to follow Fair Housing rules and screens outbound messages for explicit violations, but that screening detects overt language only. It cannot reliably detect steering — guidance toward or away from an area based on who lives there — or coded equivalents. Review AI-generated listing copy, market commentary, and messages for Fair Housing compliance before sending them.

The Service integrates third-party providers (e.g. Stripe for payments, Retell and Twilio for voice calls and text messages, Google for email/calendar, data and model providers). Your use of those integrations is also subject to their terms, and we are not responsible for third-party services.

We and our licensors own the Service and all related IP. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. We may use aggregated, de-identified usage data to operate and improve the Service.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages; and our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve (12) months preceding the claim.

You will indemnify and hold us harmless from claims arising out of your Customer Content, your outreach, or your violation of these Terms or applicable law.

These Terms apply while you use the Service. We may suspend or terminate access for breach (including non-payment) or to comply with law. On termination you may export your data for a reasonable period; thereafter we may delete it per our Privacy Policy and retention schedule.

These Terms are governed by the laws of State of Colorado, USA, without regard to conflict of laws. Any dispute shall be resolved exclusively in the state or federal courts located in Colorado, and both parties consent to personal jurisdiction there.

We may update these Terms; material changes will be notified through the Service or by email, and continued use after the effective date constitutes acceptance. Questions: legal@alchemicalai.com.
